Government Railways (Access) Bill 1998

SynopsisThe Bill will -
    • provide for the establishment of a Rail Access Code to govern the use of government railways for rail operations by persons other than the Western Australian Government Railways Commission ("Westrail");
    • designate a regulator with monitoring and enforcing functions relating to the implementation of the Code;
    • specify the kind of administrative arrangements that Westrail is to have in place for the purposes of the implementation;
    • amend the National Rail Corporation Agreement Act 1992 to enable National Rail to compete for intra-state services on equal footing with other operators; and
    • consequentially amend the WA Government Railways Act 1904 to remove existing barriers to competition.

Royal Assent given 30 Nov 1998 as Act No. 49/98 of 1998. Different sections of this Act come into operation on Royal Assent and Proclamation. For details refer to Commencement Clause of the Bill (see also Assent and Commencement information for Acts)

1. Part 6 comes into operation on the day on which this Act receives the Royal Assent. This Act proclaimed on 12 August 2000 other than Parts 3 to 7. Parts 3, 4, 5 and 7 proclaimed on 1 September 2001.
2. Stands referred to the Council Standing Committee on Constitutional Affairs until 10 July, 1998. Reinstated and referred back to the Committee until 12 September 1998.
