Inheritance (Family and Dependants Provision) Amendment Bill 2007

SynopsisThe purpose of this Bill is to update and modernise the law in relation to family provision. In particular, this Bill will enable a claim to be made against a deceased estate by a step child in two limited circumstances, and where there exists a duty to maintain a step child or there is a legitimate expectation.

The Bill will also address the following areas of family law:
  • kinship relationships;
  • costs;
  • undisclosed property;
  • interim orders;
  • probate and letters of administration; and
  • evidence.

Different sections of this Act come into operation on Royal Assent and Proclamation. For details refer to Commencement Clause of the Bill
