Long Title |
The purpose of this Bill is to ensure the retention of approximately 13.5 hectares of beach front land at Yallingup near the foreshore and Caves House. The Bill proposes to preclude a claim that the Land had been invalidly acquired in 1938; to prevent sections 29 or 29A of the Public Works Act 1902 applying to the Land and to overcome the claim that the caravan park, parking area and bush fire brigade depot were unlawfully used, by reason of a failure to comply with section 29 of the Public Works Act 1902. When encated this legislation will settle the rights of the parties which are currently in dispute in the Supreme Court proceedings. |
