The purpose of this Bill is to clarify the law in relation to licence fees by confirming that where a written law confers the power to prescribe or impose a fee for a licence the power includes power to prescribe or impose a fee that takes into account any expenditure (including future expenditure) that is reasonably related to the scheme or system under which such licences are issues. Any fee that goes beyond that reasonable relationship so as to impose taxation, or raise revenue, in a general way, will still be invalid unless it can be shown to be authorised by statute in its particular circumstances. |
