I refer to the Environmental Protection Amendment Act 2020.
(1) Which sections of the act have commenced?
(2) Which sections of the act have not commenced?
(3) In relation to (2), when will those sections commence?
Hon Matthew Swinbourn replied:
I thank the member for some notice of the question. Congratulations on her very first question. I provide the following.
(1) The majority of the act has commenced, including the streamlining and modernising provisions, the sections in part IV related to the Environmental Protection Authority and the new referral process for clearing permits under part V.
(2) The new part V, division 3 regulatory regime and provisions relating to environmental protection covenants and environmental monitoring program regulations have not yet commenced.
(3) The Department of Water and Environmental Regulation is currently investigating options to minimise regulatory burden and ease transitional arrangements with the remaining sections.
