The Bill seeks to amend section 167 of the Supreme Court Act 1935 by providing a specific head of power for the Judges of the Supreme Court to make rules for prescribing scales of, or regulating any matter relating to, the costs and expenses of proceedings, where those costs and expenses are not the subject of a determination under section 58W of the Legal Practitioners Act 1893. The current rule making powers contained within section 167 of the Supreme Court Act 1935 are not considered sufficiently wide to enable Judges to make rules prescribing scales of, or regulating matters relating to, the costs and expenses of proceedings, where those costs and expenses are not, or are unable to be made, within the determinations made by the Legal Costs Committee pursuant to section 58W of the Legal Practitioners Act 1893. |
