The Committee raised a number of concerns regarding the By-laws of the Western Australian Trotting Association - Notice of Amendment (“Amendment By-laws”) and in relation to the Western Australian Trotting Association Act 1946 (“Act”). The Committee’s concerns are set out in its correspondence to the Western Australian Trotting Association (“WATA”) being Annexures B and D to this report.
As a result of its concerns, the Committee moved a “protective” motion for disallowance of the Amendment By-laws. The motion was moved in the Legislative Council on Tuesday October 19 1999.
The Committee was satisfied with the written undertaking provided to it by the WATA in which the Association agreed to amend the Amendment By-laws in a manner acceptable to the Committee. The WATA also agreed to bring to the attention of Hon Max Evans MLC, Minister for Racing and Gaming, the Committee’s concerns with certain sections of the Act. The written undertaking is contained in the letter from the WATA being Annexure E to this report.
Due to the Committee’s concerns being adequately addressed by the WATA, the Committee resolved at its meeting on Monday November 8 1999 to seek the leave of the Legislative Council to remove its motion for disallowance of the Amendment By-laws. Leave was granted and the motion was withdrawn on Tuesday November 10 1999.
