Parliamentary Questions

Question Without Notice No. 889 asked in the Legislative Council on 9 November 2010 by Hon Lynn Maclaren

Parliament: 38 Session: 1

SUBIACO REDEVELOPMENT SCHEME — AUSTRALIAN FINE CHINA PRECINCT

889. Hon LYNN MacLAREN to the minister representing the Minister for Planning:

(1) Is the minister aware that the City of Subiaco alleges that an agreement exists between itself and the Subiaco Redevelopment Authority that the Australian Fine China precinct be developed as medium density, not high density?

(2) When the minister approved the scheme amendment regarding this precinct, was he aware —

      (a) of this; and

      (b) that the SRA’s plans would contravene the alleged agreement?

(3) If no to (2)(a) or (b), why not?

(4) If yes to (2)(a) and (b), why did the minister approve the amendment?

Hon ROBYN McSWEENEY replied:

I thank the member for some notice of this question.

(1) Yes.

(2) (a) Yes.

      (b) The Subiaco Redevelopment Authority has reviewed the Subiaco redevelopment scheme and the contract of sale with the City of Subiaco for the Australian Fine China site and believes that it has fulfilled all its obligations under the contract.
(3) As above.

(4) The minister has a number of public functions under the Subiaco Redevelopment Act 1994, including the determination of the form of any amendment to this scheme under sections 36(3) and 38(3)(a) of the act, the granting of subdivision approval under section 21(7) of the act, and the granting of development approval under sections 50 and 51 of the act.
