The purpose of this Bill is to allow the reassignment of gender and establish a Gender Reassignment Board with power to issue recognition certificates; to make consequential amendments to the Constitution Acts Amendment Act 1899 and the Registration of Births, Death and Marriages Act 1961; to amend the Equal Opportunity Act 1984 to promote equality of opportunity, and provide remedies in respect of discrimination, on gender history grounds in certain cases. This Bill was initially introduced and passed by the Legislative Council but was subsequently ruled out of order by the Speaker of the Legislative Assembly on 9 April 1997, on the grounds that it was in breach of s. 46 of the Constitution Act 1889. That Bill was subsequently re-introduced in the Legislative Assembly. |
